My husband was never served with papers. We knew they were attempting to serve one of us papers (doorbell camera), but we didn’t know which of us was being served. We both work and wasn’t home to receive notice. My curiosity led me to the courthouse to check the docket and sure enough Midland was coming after him. So we had plenty of time to prepare his answer with affirmative defenses as well as a motion to dismiss to accompany. We filed both on 7/2/25 and on 7/10/25 he received a notice in the mail for a hearing set for 8/13/25. The attorney tried to offer him a settlement before the judge came on the morning of the hearing. We respectfully declined. I had prepped my husband on what to say days before the hearing. When the judge called his name, she said “because there is no witness on the plaintiff’s side this matter is dismissed.” She informed him that they do have the right to file an appeal. It’s been over a month and no appeal has been filed.

Now on to my BIG win! I was served in July 5th 2024 and on Monday the 15th of September after a lengthy year long battle of hearings and motions, the Plaintiff finally waved their flag and filed a motion to dismiss!

The case had gone silent after I submitted my admissions, request for production and interrogatories on 7/10/25. Then suddenly on 9/4/25, they filed a motion to continue due to the counsel being out of town on our scheduled trial date of 9/22/25. The judge granted their motion. On Monday September 15th, I received an email notification at 6:36 a.m. of their e-filing notice titled Plaintiff’s Motion to Dismiss! I jumped for joy!

We both received certified copies of the dismissals to send the CRAs for trade line deletions.

Thank you TJ for this valuable information! Without you we would’ve been so lost. I remember commenting once before asking you what should I do next. I decided to learn this information so I can truly understand what I’m doing and to help not only me and my family, but others as well.

I also would like to note, I currently have 3 open lawsuits where I’m the Plaintiff against these greedy corporations. I found violations and sued them before they got the chance to sue me. Once those lawsuits settle, I will be reporting more wins! I will also report more dismissals as they come.

Those of you who are lost, keep studying until it makes sense. You’ll get it! Just don’t EVER give up!
