  • Research Maryland’s state tax collection process for a Collection and Due process equivalent procedures, as similar to IRS.

Supreme Court Decisions and Administrative Power Changes Coming

TJ discussed the implications of recent Supreme Court decisions on administrative law and the power of the executive branch. He emphasized the importance of understanding the administrative state and its impact on individual rights. TJ also discussed the potential impact of Trump’s actions on the IRS and other agencies, suggesting that these actions could lead to a reduction in their agency power. He encouraged attendees to use the tools provided in the Delete Debt and Tax and Trust courses to protect themselves from government overreach.

TJ also invited attendees to share their success stories and encouraged premium members to raise their hands for priority questions.

Negotiating Debt Collection Practices Act

Mark shared his recent experience in a small claims court case where he lost due to the judge’s refusal to hear his argument about the creditor’s validation process. TJ advised Mark to negotiate with the creditor before going to court and to file separate suits for each violation of the debt collection practices act. TJ also emphasized the importance of preserving the record for appeal and objecting to testimony from unqualified witnesses. Mark acknowledged his mistake of filing all cases under the same suit. Thus, TJ mentioned he should plan to file another case for each separate violation. TJ encouraged Mark to continue learning and preparing for future cases.

Wells Fargo Credit Card Debt Case

TJ and Matthew discussed Matthew’s case against Wells Fargo, which involved credit card debt and a recent summons. Matthew expressed concern about the short timeline and the possibility of being sued without sufficient evidence. TJ advised Matthew to file motions to delay the process, so he can focus on proving “inaccuracy” in Wells Fargo’s claims. They also discussed the importance of accuracy in court proceedings and the potential for filing counterclaims. Matthew planned to continue with the process, including sending debt validation letters and requesting tax records.

Small Claims Court Precedence Explained

TJ explains that new small claims court cases can take precedence over existing cases, and courts will usually pause other proceedings until the small claims case is resolved. But YOU must be the one notifying the other court to defer their actions. He advises Matthew that if the amount exceeds the small claims limit, he can file a civil or federal claim instead. TJ shares an example of how using a due process strategy stopped multiple court cases for one of his clients. He emphasizes the importance of notifying all parties when initiating this process.
